The Noise at Work Regulations 1989 is the main legislation in the UK regarding the protection of workers from noise making redundant the Department of Employment’Äôs Code of Practice for Reducing the Exposure of Employment Persons to Noise. The Noise at Work Regulations 1989 apply to all employees, trainees and self-employed in workplaces, excluding those on aircraft and shipping and, by analogy with the Act, all those at home.

When appointed, Acoustics Plus will undertake a noise assessment in accordance with the requirements of the Noise at Work Regulations 1989. It is most usual for Acoustics Plus to be appointed by a company who has been requested by the Health & Safety Executive to provide evidence of compliance with the Noise at Work Regulations 1989. The employers general duty under Regulation 6 of the Noise at Work Regulations 1989 is to reduce the risk of noise damage to the hearing of employees to the lowest level reasonably practical.

By Regulation 4 of the Noise at Work Regulations 1989, employers must make adequate arrangements to assess the exposure of workers to noise at or above the first action level or the peak action level. This must be made by a competent person who can advise on action to be taken, including taking specialist advice. Acoustics Plus is able to undertake this service.

Regulation 8 of the Noise at Work Regulations 1989 requires that where employees are likely to be exposed to the first action level or above, then suitable and efficient personal ear protectors must be available to those who request them. But by Regulation 8(2) of the Noise at Work Regulations 1989, ear defenders must be provided where there is exposure at or above the second or peak action level.
